Joelle Bisimwa is an Associate in the dispute resolution team.
She was admitted as a solicitor in 2020 following the completion of her training contract with a specialist Commercial Litigation firm.
Joelle is effective in litigation, arbitration and mediation concerning breach of contract, contentious insolvency, fraud, directors’ and shareholders’ disputes.
She has over five years’ experience acting on complex, multijurisdictional claims for various clients including creditors, debtors, minority shareholders, liquidators, football agents, and transnational corporations.
Recent experience:
- Acting for corporations in connection with claim in respect of their liability pursuant to high-value loan agreements and achieved successful settlement of the same.
- Acting for a bank in connection with a worldwide freezing order obtained following a claim for wrongful trading. Successfully discharged the worldwide freezing order and obtained a costs award at circa 75%.
- Acting for a Joint venture in an arbitration under the ICC rules 2021.
- Acting for an individual in a claim brought by creditors, and concerning a transaction made in America at an undervalue following an individual voluntary arrangement. Successfully petitioned the court that there should be a preliminary hearing on the matter to determine the interpretation of the will which was a key document in the defence. This Significantly limited further liability in relation to costs and helped bring about a successful settlement of the claim.
- Acting for a doctor in his widely reported claim brought against the Secretary State of Health and another party in connection with his tortious conspiracy claim. Successfully joined the Secretary State of Health to the claim after the Supreme Court agreed the Claimant had reasonable prospects of success and thereafter, successfully obtained settlement following mediation and further settlement discussions.
- Acting for creditors and debtors in connection with statutory demands and winding-up petitions.
- Acting for the liquidators seeking recovery of assets from a debtor in a widely reported case. Discerned a series of relevant transactions and successfully petitioned the court for a determination that the Defendant was the ultimate beneficiary. Prepared and issued possession and sale proceedings and served them out of jurisdiction. Thereafter, successfully enforced the judgment order including by way of a writ of control over qualifying assets to maximise recovery during ongoing settlement discussions.
