On 25 February 2021, the Serious Fraud Office (“SFO”) announced it had charged Gianni Rivera, a biodiesel trader with money laundering following its investigation into the sustainable fuel sector.

The SFO opened their investigation into Greenergy Fuels Limited (“Greenergy”), a UK based biodiesel producer in December 2018 and publicly announced in May 2019 that their investigation was being completed in partnership with the Dutch authorities.
Gianni Rivera, who is a former employee of Greenergy has been charged by the SFO with two counts of fraud by abuse of position, contrary to section 1 of the Fraud Act 2006 and one count of money laundering contrary to section 328(1) of the Proceedings of Crime Act 2002. The central allegation is that when Gianni Rivera was agreeing trades between Greenergy and Biodiesel Kampen BV, a Dutch trading partner he was receiving payments from Cornelis Bunschoten, one of their directors. The investigation uncovered that on numerous occasions a portion of the monies Gianni Rivera received were transferred to companies linked to Cornelis Bunschoten.
Gianni Rivera appeared at Westminster Magistrates’ Court by video link on Thursday 25 February 2021. This remains an active case and one to watch as it continues to unfold.
