Rosenblatt’s client, Dr. George Bitar, has succeeded in his claim in the English High Court against Banque Libano-Francaise S.A.L. (the “Bank”). In advance of providing judgment, the Court has indicated that Dr. Bitar succeeds in his claim, and made an order for specific performance.
Dr. Bitar (a UK national) commenced a claim in 2021, seeking repayment of funds in his account with the Bank. Dr. Bitar alleged that the Bank had refused to execute his instructions to make an international transfer of funds including to his account in the UK. The Bank defended the action, which was tried in early-mid November 2022. Dr. Bitar’s claim arose in the context of Lebanon’s financial crisis which led to Lebanese banks restricting their customers’ ability to transfer funds.
On 28 November 2022, and less than 2 weeks after the trial concluded, Mr. Justice Kerr gave orders for specific performance (with judgment to follow).
